Terms of service

1. Rental Rates Daily rental rates are charged per day, starting at the time of rental. The minimum charge is one day plus mileage if applicable. The renter will incur charges for each hour (or part thereof) beyond the rental day until the vehicle is returned, up to the daily rate. Mileage charges are determined by the odometer readings at the beginning and end of the rental. Rental rates may increase if the vehicle is returned more than 24 hours before or after the scheduled return time. Late returns, beyond a 30-minute grace period, may be subject to additional hourly or daily charges. Failure to comply with geographic driving restrictions may result in mileage charges, surcharges, or alternative rates.

2. Driving Age: The minimum age to rent a vehicle with Gatsby Tours & Travel is 25 years. Exceptions may be granted under special consideration.

3. Authorized Drivers: Vehicles may only be driven by authorized drivers, including the renter and any additional individuals who appear at the time of rental and sign the rental agreement. All authorized drivers must meet age requirements, hold a valid driver’s license, provide a residential address, present a major credit or debit card in their name, and satisfy other qualifications. Employers and co-employees of renters on corporate rate plans who are properly licensed and meet age requirements may also drive the vehicle within the scope of their employment. Driver record checks may apply to all authorized drivers.

4. Additional Authorized Drivers and Fees All additional authorized drivers, including spouses, must meet the qualification criteria, such as minimum age requirements and providing necessary documentation. Additional driver fees and driver record checks may apply.

5. Underage Driver’s Fee: Drivers aged 20 to 24 years may incur an underage driver fee, charged per day, in addition to any additional driver fees.

6. Fuel Policy Renters are responsible for refueling the vehicle at their own cost and must return the vehicle with the same fuel level as when rented. Failure to do so will result in refueling charges plus a service fee.

7. Disabled Renters: If driving aids are required, please contact Gatsby Tours & Travel at +254 720 390187 to ensure availability and installation before the rental.

8. Pick-up Services: Please call +254 720 390187 upon arrival for complimentary pick-up services at the airport.

9. Risk, Delivery, and Return The vehicle remains at the renter’s sole risk from the time of delivery until its return. Vehicles must be returned in the same condition as received, except for normal wear and tear, to the designated return location specified during the booking.

10. Payments: Renters are responsible for all fees, taxes, tolls, and other expenses incurred during the rental period. Charges may include one-way fees, towing charges, or damages. Renters must reimburse the company for any losses or damages resulting from theft, fire, or other incidents. Payment is due upon demand, and late payments may incur interest and legal action.

11. Extension of Rental Period: Any breach of the agreement may result in termination, with outstanding amounts becoming immediately payable. The agreement remains effective until all obligations are fulfilled.

12. Termination: The rental agreement may be terminated upon any breach by the renter, with outstanding charges immediately due. Obligations continue until the vehicle is returned and all conditions are met.

13. Indemnity: Gatsby Tours & Travel is not liable for damages, injuries, losses, or consequential damages due to mechanical failures or defects, except as required by law.

14. Responsibility After Loss or Damage to Vehicle In the event of an incident:

• Notify Gatsby Tours & Travel promptly.
• Cooperate in investigations or legal processes.
• Take steps to prevent further damage to the vehicle. Failure to comply may result in additional charges and void insurance coverage.

15.General Provisions

1. Rights or obligations under this agreement cannot be transferred without prior written consent.
2. Unauthorized repairs or modifications are prohibited.
3. The renter remains liable for all obligations, even if not the driver.
4. The laws of the rental jurisdiction govern the agreement.
5. Leniency does not waive the company’s rights.
6. By using our services, the renter consents to credit checks and reporting defaults to credit bureaus.

   Acceptance of these terms confirms understanding and agreement to abide by them.
